Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and Ability Avenues, LLC (“Ability Avenues,” “we,” “us,” or “our”) governing your use of https://abilityavenues.com and everything on it (the “Site”). By using the Site — including by submitting any form on it — you agree to these Terms. If you don't agree, please don't use the Site; you're always welcome to reach us directly by phone instead.
Who we are
Ability Avenues, LLC provides center-based and in-home ABA therapy and EIDBI services for children ages 2–12 from our center at 1415 Lilac Dr N, Suite 140, Golden Valley, MN 55422. You can reach us at (952) 900-2344 or info@abilityavenues.com.
Eligibility & authority
The Site is intended for parents, legal guardians, and healthcare or education professionals acting on their own behalf or on behalf of a child in their care. By submitting a form about a child, you confirm that you are that child's parent or legal guardian, or a professional with the authority and consent needed to share that child's information with us for a referral. You must be at least 18 years old to submit the career application.
Using the site
We grant you a limited, non-exclusive, non-transferable license to view and use the Site for your own personal or professional informational purposes. You agree not to:
- Submit false, misleading, or fraudulent information through any form;
- Use the Site to harass, defraud, or send unsolicited communications to anyone;
- Attempt to gain unauthorized access to the Site, its underlying systems, or any account or data it processes;
- Scrape, copy, or republish the Site's content at scale, or use automated means to access it beyond normal search-engine indexing; or
- Interfere with the Site's normal operation, including by introducing malicious code.
We may suspend or block access from anyone who violates these Terms.
Not medical advice
Content on this Site — including pages about autism, ABA therapy, EIDBI, and our blog and glossary — is educational and general in nature. It is not medical, diagnostic, or clinical advice, is not a substitute for evaluation or treatment by a qualified professional, and does not create a therapist-client, provider-patient, or any other clinical relationship between you and Ability Avenues. That relationship begins only once formal intake is complete and a plan of care is in place. If you have concerns about your child's development, please consult a qualified healthcare provider or contact us to discuss an evaluation.
Insurance & coverage information
Information on the Site about EIDBI, Medical Assistance, TEFRA, MinnesotaCare, or accepted insurance is general and educational. It is not a guarantee of coverage, eligibility, or benefits for any specific person. Coverage depends on your individual circumstances and your plan's current terms, which we'll verify with you directly as part of getting started — nothing on this Site substitutes for that conversation.
Forms & submitted information
You're responsible for the accuracy of anything you submit through our forms, and for keeping any confirmation details (dates, reference information) you receive from us. Please review our Privacy Policy before submitting a form — it explains what we collect and, in particular, why our web forms are not the right place for detailed medical or diagnostic information. By submitting a form, you consent to be contacted by phone, email, or text (if you opted in) at the information you provided, about your inquiry.
Text messaging (SMS) program
If you opt in to text messages on the contact form, you agree to receive SMS messages from Ability Avenues related to your inquiry. Message frequency varies; message and data rates may apply. Text STOP to any message to opt out at any time, or HELP for assistance. We are not liable for messages that are delayed or undelivered due to your carrier or device.
Career applications
Submitting a career application does not guarantee an interview, offer, or any form of employment. Ability Avenues is an equal opportunity employer; employment decisions are made without regard to race, color, religion, sex, national origin, age, disability, or any other protected status, and all employment is at-will. Any gender or race/ethnicity information you provide on the application is voluntary, used solely for equal-employment monitoring and reporting, and has no bearing on our hiring decision.
Intellectual property
The Site — its text, graphics, logos, and design — is owned by Ability Avenues or its licensors and is protected by copyright, trademark, and other laws. Other than the limited license above, nothing in these Terms transfers any intellectual property right to you, and you may not use our name, logo, or branding without our prior written permission.
Third-party links & resources
The Site links to outside organizations — for example, the Minnesota state programs and community resources listed on our resources hub. We provide these links for convenience; we don't control those sites, don't endorse their content, and aren't responsible for what you find there. Visiting a linked site is at your own risk and subject to that site's own terms.
Disclaimer of warranties
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the Site will be uninterrupted, error-free, or completely secure, or that any information on it is complete or current at every moment.
Limitation of liability
To the fullest extent permitted by Minnesota law, Ability Avenues will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if we've been advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for our own gross negligence or willful misconduct, or any liability arising from clinical services once a client relationship is established under separate service agreements.
Indemnification
You agree to indemnify and hold Ability Avenues harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.
Governing law & venue
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Hennepin County, Minnesota, and you consent to jurisdiction and venue there.
Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continuing to use the Site after a change means you accept the updated Terms.
Termination
We may restrict or terminate your access to the Site at any time, for any reason, including if we believe you've violated these Terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
General provisions
If any provision of these Terms is found unenforceable, the rest remain in full effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and Accessibility Statement, make up the entire agreement between you and Ability Avenues regarding the Site.
